Example
In the case of Pape v Federal Commissioner of Taxation ('Pape'),1 the Court examined executive power. Similarly, Williams v Commonwealth of Australia [No 2] ('School Chaplains'),2 examined the power of the executive government under s 61 of the Australian Constitution. In Pape, the Court found the legislation made was incidental to the exercise of the Commonwealth Government of its executive power.3
